Terms of Service

These terms are the agreement between you (the Australian tradie subscribing to the service) and Alisya AI (the operator of Tradie Pilot AI). They are written to satisfy the Australian Consumer Law and other applicable Australian laws.

1. Who we are and acceptance

Tradie Pilot AI is operated by Alisya AI ("we", "us", "our"). By signing up via the /free-trial form, completing the concierge onboarding call, or otherwise using the service, you agree to be bound by these terms.

These terms apply to the V1 version of the service, currently available to a limited Greater Brisbane launch cohort. They will be updated when the service is opened to nationwide self-serve onboarding.

2. The service

The V1 service consists of:

  • A dedicated AU mobile number provisioned to you on Twilio.
  • Call-forward configuration so missed calls on your existing mobile reach our system.
  • An AI-driven first-response SMS sent to the customer on your behalf, targeted within five seconds of the missed call.
  • AI emergency triage on inbound SMS replies, drawing safety tips from a vetted library only.
  • A web inbox where you can read every conversation and reply.
  • Founder-notification email + SMS during your concierge onboarding window.

The voice channel is not answered by AI in V1. The roadmap of record for what is and is not in scope is published at docs/ROADMAP.md in our public source repository. We do not name a feature or integration in marketing copy unless it is live in that document.

3. Your account

You may create one account per business. You are responsible for keeping the account credentials secure and for any activity that occurs under the account. If you suspect unauthorised access, email privacy@tradiepilot.ai immediately.

You agree that the information you give us at sign-up is true, accurate, and current, and that you have authority to bind the business you nominate.

4. Trial and billing

4.1 Free trial

The trial is 30 days from the day your AI mobile number goes live. There is no setup fee. No payment information is required to submit the /free-trial form.

4.2 How and when payment is collected

Payment information is collected verbally during the concierge onboarding call, only after you confirm you wish to continue past the trial. The first charge runs on day 31. If you cancel at any time before day 31, no charge is made and no further action is required from you.

4.3 Subscription price

The subscription is AUD $199 per month, billed monthly in advance starting day 31. Prices include GST where applicable. Price changes will be notified at least 30 days in advance and will only apply to billing periods after the change.

4.4 Cancellation

You may cancel at any time by emailing billing@tradiepilot.ai. When the Stripe self-service portal lands (per the roadmap of record), cancellation will also be available in-app. Cancelling ends future billing; we do not refund the current month except where required by the Australian Consumer Law (see §10).

4.5 What you keep on cancellation

Every job we have already booked for you stays yours. We will continue to relay any inbound SMS the customer sends to your dedicated AI number for 14 days after cancellation, so any in-flight conversation can complete.

5. Acceptable use

You agree not to use the service to:

  • Send unsolicited commercial messages outside the missed-call response flow.
  • Send messages that are deceptive, harassing, or unlawful.
  • Pretend to be a human when you are not, where deception would cause harm. (The AI receptionist identifies itself as an AI assistant in the first SMS body — see §6.)
  • Reverse engineer, scrape, or attempt to extract the underlying AI prompts or models.
  • Provide the service to a third party as if it were your own product (white-labelling is not permitted in V1).

6. AI receptionist disclaimer

The first SMS sent on your behalf identifies itself as your business's AI assistant (e.g. "Hey, this is [Your Business] AI assistant — sorry I missed your call…"). This is by design and required for fair-dealing reasons.

Tradie Pilot AI uses a large language model to classify and reply to inbound messages. Like any AI system, it can make mistakes. The service is designed with safety guardrails:

  • Safety tips are drawn from a vetted library; the AI does not free-form medical, legal, or electrical advice.
  • The AI does not commit you to a specific arrival time. It states you will attend after wrapping the current job; you confirm the actual ETA.
  • The AI does not negotiate price beyond a clearly displayed emergency callout fee that you configure.

You acknowledge that the AI is operating on your behalf as your receptionist. You remain responsible for the work you do for your customer, including pricing, scheduling, materials, safety, and the quality of the work itself. Subject to §10 (Australian Consumer Law), Alisya AI is not liable for the work you perform for your customers as a result of a lead generated by the service.

7. Outbound SMS and Spam Act compliance

Every outbound SMS sent on your behalf is subject to the Spam Act 2003. Specifically:

  • We rely on inferred consent because the customer has just attempted to call your mobile.
  • Every outbound SMS body identifies your business by name in the first sentence.
  • Every outbound SMS includes a functional unsubscribe path ("Reply STOP to opt out"). Inbound STOP messages are honoured immediately and forever; we will not send further commercial SMS to that number.

You agree not to instruct us to send messages that are not compliant with the above. If we detect a pattern of misuse, we may suspend the service and require remediation before reactivating.

8. Data ownership

You own the lead data and the customer-conversation data generated through your account. We hold this data as your processor for the purpose of running the service. On reasonable request we will export your data to you in a standard format (CSV or JSON) within 14 days.

We own the AI prompts, the safety library, the operational metadata (latency, error codes, classifications), and any de-identified, aggregated insights derived from the data we process. We do not sell your data to any third party.

9. Liability

Subject to §10 (Australian Consumer Law), our maximum aggregate liability to you under or in connection with these terms in any 12-month period is the greater of:

  • The total subscription fees you have paid us in that 12-month period; or
  • AUD $200.

Subject to §10, we are not liable for indirect or consequential loss, loss of profits, or loss of business opportunity.

10. Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other law that cannot be lawfully excluded.

If you are a consumer for the purposes of the Australian Consumer Law, our goods and services come with guarantees that cannot be excluded. If a guarantee is breached, you are entitled to the remedies provided by the Australian Consumer Law, including, where applicable, repair, replacement, or refund.

11. Suspension and termination

We may suspend or terminate your access to the service if:

  • You do not pay an amount that is due.
  • You materially breach these terms (including §5 acceptable use or §7 Spam Act compliance) and do not cure the breach within 7 days of being asked.
  • We are required to do so by law or by direction of a regulator.

You may terminate at any time per §4.4. On any termination, you keep the data we have generated for you (per §8).

12. Changes to these terms

We may update these terms from time to time. Material changes will be notified to you by email at least 14 days before they take effect. If you do not accept the change, you may cancel before it takes effect; your continued use after that date is acceptance.

13. Governing law

These terms are governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland and the federal courts of Australia.
